The Missing Minutes ???

 
The Jeffersonville - Clark Co. Blog has received  what is alleged to be the original minutes of the Sept. 1, 2011 Redevelopment meeting, where Walnut Ridge owned by Jeffersonville mayoral candidate Dennis Julius is awarded the contract for the controversial Hwy 62 median landscaping project. The BatBlog did not get this through an open records request, they were e-mailed to the BatBlog account and the BatBlog (see disclaimer below) does not verify or claim they are the originals...only that this version  exists. It will be interesting how this version  compares to the ones apparently found and supposedly available through open records requests.

  The "Missing Minutes" the Batblog received aren't clear whether Julius as a sitting member of the Redevelopment Commission abstained or voted for the awarded contract,(bottom page 2) though it does say the vote was unanimous... Readers can make their own determination and interpretation , and actually it may be a moot point because it seems in the BatBlog's opinion that by Julius merely being a member of the Redevelopment. Commission and receiving and obtaining the benefits of the contract he may have been in violation of Indiana law:

(b) A transaction made in violation of this section is void

                                     JEFFERSONVILLE REDEVELOPMENT COMMISSION
                                                      SPECIAL MEETING MINUTES
                                                            SEPTEMBER 1, 2011

 The Jeffersonville Redevelopment Commission held a Special Meeting on September 1, 2011 at 5:30 PM in the Second Floor Conference Room, 500 Quartermaster Court, Jeffersonville, Indiana. The following were present:

James Lake, President
Derek Spence, Vice President
Dennis Julius, Secretary
Nathan Samuel

Mary Sue Ellenbrand, Secretary
David Lewis, Attorney
Andrea Stevens, Interim Director

Guests: Mike Hutt

Absent: Robert Stevens

CALL TO ORDER: Mr. Lake called the meeting to order at 5:30 PM.

CLAIMS: Ms. Stevens presented claims for $545,754.12 and $97,866.44 and property acquisition claims for $1,093,431.77. Mr. Spence made a motion to approve the claims. Mr. Julius seconded. Motion passed unanimously.

BIG FOUR BRIDGE LANDING STREETSCAPE PROJECT:

Ms. Stevens presented R-19-2011 which is a resolution that the Redevelopment Commission supports the city of Jeffersonville’s submittal of an application for grant funding to the Indiana Office of community and Rural Affairs to address the Big Four Bridge Landing Streetscape Project. The Redevelopment Commission commits the requisite local funds in the amount of $135,969.50 from the Falls Landing Tax Increment Financing District, as matching funds for the program. This commitment is contingent upon receipt of MSRP funding from the Indiana Office of community and Rural Affairs.

Mr. Samuel made a motion to approve R-19-2011. Mr. Julius seconded. Motion passed unanimously.

RESOLUTION NO. 2011-R-20:

This resolution adopts a list of real property interest to be acquired and the prices to be offered to the owners of such parcels. Due to Mr. Lewis not having prior information on this resolution the resolution was tabled until the next meeting. The commissioners did agree that the offers in Exhibit C could be made. Mr. Samuel made a motion to allow Ms. Stevens authorization to make offers in Exhibit C. Mr. Julius seconded. Motion passed unanimously.

FIRE DEPARTMENT MEMORIAL:

Ms. Stevens reported that the Fire Department will be dedicating a memorial on September 11, 2011. They are asking for $5,000 to landscape and finish the area. Mr. Spence made a motion to approve $5,000 for the Fire Department. Mr. Samuel seconded. Motion passed unanimously.

JEFFERSONVILLE BUILDING CORPORATION REINSTATEMENT AND ASSOCIATED FEES:

Ms. Stevens reported that the Jeffersonville Building Corporation needs to be reinstated. If this happens there will be fees involved. Ms. Stevens is asking the Redevelopment Commission to fund the fees when the reinstatement takes place. Mr. Lewis will investigate and report back at the next meeting.

BID SELECTION – 10TH STREET MEDIAN PLANTING PROJECT:

Ms. Stevens presented the bid for the 10th Street Median Planting. Walnut Ridge was the only bid. The bid was for $419,601.15. Mr. Samuel made a motion to approve Walnut Ridge’s $419,601.15 bid for the 10th Street Median Planting and authorize the Department of Redevelopment to enter into the contract. Mr. Spence seconded. Motion passed unanimously.

ADJOURNMENT: Mr. Lake asked if there were any additional business. Mr. Julius made a motion to adjourn the meeting. The motion passed unanimously. The meeting was adjourned at 6:20 PM.

  5. Good Question Anon 1....I had serious trepidation at first and waivered back and forth on whether to post it. Two things changed my mind first there is no smoking gun here, there is no clear evidence Julius actually voted or abstained. Second I received some information that made me believe it was legit...

    Either way it's a story, either it's real or somebody went to a lot of trouble to play a dirty political trick on the BatBlog...

    If it's fake and I feel 99% sure it isn't... I'll rescind it and expose it for a dirty trick and if it is a trick it could backfire on those responsible.

    I know what I received is real ...I didn't make it up ...it exists and I printed a disclaimer...I have no political agenda and feel it's important that voters can read it and make there own determination of it's importance and how they interpret it.

    Miracles do happen... NHBSM said it would be a miracle if the minutes appeared which I find more interesting then what the content is in them...

  9. I have a copy as well. Unfortunately the PDF has two
    blank pages at the end. It is a transcript not a photocopy.
    There is no signature block as is common with these documents. I wanted to check the signatures against known documents. It looks good but I can't verify it.
    If there's a complete photocopy of these minutes, contact me through the CCC.

  10. My copy has two blank pages as well RF, while that was an issue with me as well I also received some documentation that made me feel almost positively that the minutes are in fact those that strangely came up missing.

    If someone has something to show these are faked I'll gladly print a retraction, apology and print the genuine copy....but I don't think that will happen..Thanks for the offer to help...

  12. The "Perennial Stalker Guy"
    on the CCC is really sweating the located minutes
    and trying to strangely
    "explain" and spin them.

    It is fun to watch him squirm!

    The self-appointed stalker dude previously stated
    that the minutes were "lost or shredded !
    This was done BEFORE anything was revealed on the Bat Blog
    or other watchful media.
    Could it be a weak PREMPTIVE weak "cover up" attempt?

    Why would the 'Perennial Stalker Guy' think
    that the minutes would have been intentionally attempted to be destroyed
    ('LOST or SHREWDED") before the new administration came in on January 1, 2012 ?

  13. Uh, oh...
    it looks like the electronically recovered minutes
    that have now been permanently saved, show that the members at the next,
    subsequent Redev Commission meeting APPROVED the previous
    "unanimous vote" minutes on the plants for the median mess.....
    No previous abstention was noted from the previous meeting.

    Apparently they approved the minutes that showed NO abstention from the last meeting. All of the members present approved those meetings.

    Dern electronic stuff.

    The contracts were received.
    The median was a mess.
    It has cost a lot of taxpayer money
    and the additional yearly $100,000 Excessive Maintenance Boondoggle
    has now been eliminated by the mayor.

    As I read the ongoing discussion of this 10th Street Plant Scandal,
    it is observed that "The Perennial Stalker Guy'(aka 'not super')
    and 'The Perennial Candidate Guy' (aka 'Kevin in 07/08/11/12/15')
    are both to be really in the tank defending plant boondoggle.

  15. Bat Blog Investigative Journalism Update

    The one not=super personage posted strangely on the CCC:
    "And one more time....the standard conflict of interest disclaimer
    was all the city's legal council has said needed to be signed in the past.
    I was told to sign one when I was on the ethics commission."

    "At the time it was thought that piece of paper made everything legal."
    Huh?
    Gulp.
    This weak spin attempt just keeps getting better and better.
    It is getting deeper.

    A reading of the state statute clearly states
    that if a member of the commission has a "pecuniary interest" in a contract
    with the Redev Com while a member,
    that the contract is void.

    that there will be a lot more nice things occurring in Jeffersonville.

    The city administration is getting quite a score card of accomplishments.

  18. I do not think it will hurt Julius. Why? He will never have to respond to the allegations. N&T has the minutes but I've not seen a story. Until the N&T or C-J or TV stations pursue, it will remain in oblivion.

    Newspaper, TV, radio, and other media ads.
    Ask TG how that exposure hurts....
    Very difficult to overcome the council's scandals
    when everyone is talking about them.

    The city council's soccer spending and plant spending scandals
    have already gotten very good play in the N-T
    and other media.

    They are not exactly a secret.....
    Everyone knows.
