Did Noel and Wilder Try to Pull One Over on Clark Co. ???
In the aftermath of the Bennett/ Co. Council fiasco one has to wonder if Jamey Noel and Larry Wilder were trying to "pull one over" on Clark Co. voters/residents ??? It's hard to believe neither Noel or Wilder didn't know or bother to research the residency requirements required for serving on the council. Residency which has been an issue in other local elections ("Toxic" John Perkins") and eligibility you would think would be the first thing checked especially for a candidate that has just recently moved into this area...
Kudos to the News/Tribune that reportedly brought to attention that Bennett wasn't eligible under Indiana law. Bennett immediately withdrew from his appointment claiming ignorance of the law, but The BatBlog wonders why a man with Bennett's education and political experience didn't know or research the law as well ??? Peculiar...
Other questions have arisen as well of the whole process of Bennett being caucused into the county council seat. How did Bennett know that Brian Lenfert's 2nd Dist. seat would even be open ??? As far as we know Lenfert NEVER "publicly" announced he was a candidate for the open "at large" position. It was rumored (on The BatBlog) but just rumored no announcement.
Question 2. Why didn't Lenfert publicly announce he would be attempting to switch positions and give other potential candidates a heads up to his possible vacant seat ??? Bennett was the only one interested and considered for Lenfert's vacated council seat...Was it because he was the only one who knew there would be an opening ??? Also it has been reported to the BatBlog that curiously Bennett only registered to vote in Clark Co.a week before the GOP caucus ...
Maybe this was all coincidental and this wasn't a concerted effort by Noel, Bennett and Wilder to slide Bennett on to the Clark Co.Council. Without proof of intent we will have to assume that Noel and Wilder aren't a pair of "Snake oil " salesmen trying to dupe the voters of Clark Co....but what's the old saying ??? If it walks like a duck , talks like a duck ????

It is somewhat unfathomable that the man in the can did not know that.
ReplyDeleteFound this interesting - if Brian Lenfert vacated his position the night of the caucus, then the Republican Party could not have caucused Tony Bennet in the same night. Looks like that move may have been against Indiana Law.
ReplyDelete3-13-11-3 Calling of caucus; withdrawal of resignation; when caucus to be held
Sec. 3. (a) Except as provided in subsections (b) and (e) and section 3.5 of this chapter, not later than ten (10) days after a vacancy occurs in an office subject to this chapter, the county chairman:
(1) of the county in which the greatest percentage of the population of the election district of the office is located; and
(2) of the same political party that elected or selected the official who vacated the office;
shall give notice of a caucus to all eligible precinct committeemen.
(b) A county chairman may give notice of a caucus before the time specified under subsection (a) if a vacancy will exist because the official has:
(1) submitted a written resignation under IC 5-8-3.5; or
(2) been elected to another office.
(c) Notwithstanding IC 5-8-4, a person may not withdraw the person's resignation after the resignation has been accepted by the person authorized to accept the resignation less than seventy-two (72) hours before the announced starting time of a caucus under this section.
(d) Except as provided in subsection (e) and section 3.5 of this chapter, a caucus under this section shall be held after giving notice to caucus members under section 4 of this chapter and not later than thirty (30) days after the vacancy occurs.
(e) If a vacancy exists in an office because of the death of the officeholder, the caucus shall meet and select an individual to fill the vacancy not later than thirty (30) days after the county chairman receives notice of the death under IC 5-8-6. The county chairman shall give notice to caucus members under section 4 of this chapter. The county chairman may not give the notice required by section 4 of this chapter until the county chairman receives notice of the death under IC 5-8-6.

3-13-11-4 Notice of caucus
Sec. 4. The notice for a caucus under section 3 of this chapter must:
(1) be in writing;
(2) state the name of the chairman of the caucus;
(3) state the purpose of the caucus;
(4) state the date, time, and place of the caucus; and
(5) be sent by first class mail to each member of the caucus at least ten (10) days before the caucus.
Good Job Anon !!! It appears that several different sections of this statute have been violated.

Wonder IF these statutes HAVE been violated will C.C. prosecutor file charges against the GOP chair/ sheriff ???

It is obvious this was a failed manipulation of the system to put Bennett in this seat. The question is who were all the actors who participated in this sham? Was Lenfert part of this? We're higher ups in the state republican party pulling Noel's strings to get Bennett a position?

Residents here are very fortunate.
Tony Bennett is an exceptionally well qualified governmental administrator.
He would have been a very good Clark County Councilman. His efforts in Indianapolis on behalf of Clark County government
and his stewardship of local spending
would have been very beneficial.
It would have benefited Clark County
for a person of his quality to serve as a public official here.
Obviously, Sheriff Jamey Noel
is a very accomplished politician
with a great future and a lot leadership
left in the tank for maybe 20 years. Sheriff Noel
is only at the beginning of the third year of his first term.
Larry Wilder and David Mosley,
whom often represent the R's and the D's
respectively, are two of the best of the many
good Clark County barristers. They add to

Of course "a fast one" was attempted. It's the Noel way of doing business. I said from day one over on CCC he was a major disappointment after I learned how he treated his employees that were not on his side of the political fence and that was just the beginning. He has became the leader of a bunch of crooks. It was very sad to learn he was staying in Clark County after all the rumors of him getting some thank you job handed to him at the state level. Now before someone accuses me of being a sore loser democrat, and again like I have stated over there on CCC, I did vote for the guy. That will never happen again. I have made a point to pass on to my family, their extended families, and all friends this clown needs to be thrown out of Clark County. Probably won't happen but at least we are going to try next time. Lies,broken promises, and many "special deputies" is all we have got out of him.

Swank and White are no improvement I'm sorry to day. The party needs more young bloods who are in touch with today's issues. Not older party members who are nominated for political favors and stand to financially benefit from the County.

ReplyDeleteHe or Laura Harbison would be a fresh start. Someone who has no vested financial interest in Clark County Politics. And no one who is in anyway related to a judge or office holder. No more " hey I have a great insurance deal for the County"! That scam has been going on for way too many years in Clark County.
