Update...Sewer Wars and "The Bully" Kevin Jong Baity

Kevin Jong Baily wants 1 1/2 million or flooding will occur.

Clarksville leader Kevin Jong Baity has given the city of Jeffersonville a little more time in his extortion attempt to relieve the City of Jeff of 1 1/2 million dollars to pay for a C'ville flooding project. CLICK HERE FOR STORY  Jong's original threat had a deadline of Mar.1 before Clarksville was to put in place a plan to flood downtown Jeffersonville in retaliation for not paying the 1 1/2 mil ransom. General and mayor Mike "Blood and Guts" Moore has refused to bow to Jong Bailey's threats and in the N/T article said ... "My dad always told me to stand up to bullies, so I guess that's about to happen,"

 As it now stands both leaders have drawn a line in the sand refusing to back down. The BatBlog believes that Jong Bailey was given an intelligence briefing that informed him that in retaliation Jeff and former Navy Seal HT were considering a counter attack operation to take out  Clarksville's historical landmark and culture and arts center Theatair X... if Jeff was attacked with flood waters.

 It appears depriving Clarksvillians of their main source of culture and entertainment would be too big a risk for Jong and he his in a quandary as to his next step forward to extort Jeffersonville; thereby the delay. The BatBlog advises all downtown residents to be on high alert as Jong Baity appears to be as unstable as his idol Kim Jung and flood waters coming from C'ville may be imminent.

 If attacked HT has informed mayor/general Moore that all he needs is the word and Theatair X is history. Top Secret counter measures include rerouting Jeff sewers directly into Theatair X and flooding it out is being seriously considered. The facility (Theatair X) is rumored to hold a hidden war bunker where Jong Baity and his town council will occupy if hostilities begin. HT has also informed Moore that if necessary one well placed bazooka round will reduce Theatair X and C'villes headquarters to rubble...

    The Goliath plan:

    1. Pour molten concrete into all the sewer outlets from which the backed up water supposedly
    would spill out the Clarksville water to flood 10th street.

    2. Erect barricades at the Jeff-Clarksville boundaries. Cutting off All Clarksville access to the Falls of the Ohio Center, Stansifer avenue, and all other Clarksville accesses points from the beloved Jeffersonville confines.

    3. Trade embargo on lawyers. No Jeff located lawyers will be allowed to travel to Clarksville or work on 'court pleadings'. Fifer, Sturgeon etc., will have hands tied behind back.

    4. Send a JPD force in to occupy the George Rogers Clark homesite. (only actual point of pride for Clarksville).

    5. Since Cville town board passed a 'guns are allowed' ordinance, make sure to send in teams of heavily and openly armed Jeff partisans to all Clarksville civic meetings. I am talking AKs and bandoleros. OPEN CARRY.

  5. Never been a big Moore fan, but just gained some respect for him after this public threat by the seven horsemen and their six figure henchman. Where do these idiots get off threatening our neighbors for not wanting to pay for their problems and screw ups ? Keep up the good work Mike Moore defending your city.

  6. Chronic flooding occurs in South Clarksville when the river is above flood stage due to improper design of Flood Control's Cane Run pump station. FC's records since at least 1962 demonstrate that pump station improvements to eliminate resultant damages to properties within the FC district are needed. 40% of the FC district's assessed value come from properties in Clarksville.

    Clarksville has determined to eliminate these flooding problems one way or another, and it has every legal right to do so (Indiana follows the Common Enemy Doctrine with respect to surface water drainage per Argyelan v. Haviland, 435 N.E.2d 973 (Ind. 1982)). For approximately $1.5 million it can separate its stormwater drainage from FC's 96-inch pipe running from the Tenth Street Pump Station in Jeffersonville to the Cane Run drainage basin between the river and South Clark Boulevard, but the next lowest opening served by this pipe is likely in the area of the Tenth & Spring intersection (i.e., water might then surcharge from this pipe into Jeffersonville in the manner that it now does in Clarksville). Clarksville has accordingly offered to contribute this same $1.5 million towards the Cane Rune pump station improvements that would also eliminate these flooding problems, but without potential of adverse effect to Jeffersonville.

    As I advised the City Council, if Clarksville has to construct its stormwater separation project to prevent the flooding problems that FC is legally obligated to prevent, FC and/or Jeffersonville may still have to construct the Cane Run pump station improvements to remove stormwater from Jeffersonville, but they will then be doing so without Clarksville's generous contribution.

  8. I don't have a "case" to try over the internet or otherwise as Clarksville has not in any manner threatened litigation against Jeffersonville. Nor has it ever threatened to intentionally flood Jeffersonville as has erroneously been claimed.

      The alternative plan is to install a separate drainage line and seal off storm drains near the south end of town, which overflow during heavy rainfall. With no other outlet, officials say the only place for water to back up is in Jeffersonville near 10th Street and Interstate 65. "

    3. How is flooding a legal problem? I would think this is an engineering problem and what gives you the right to "seal off" pipes that will cause flooding in another city? Surely there is an alternate solution that doesn't involve Jeff.

The Common Enemy Doctrine provides that a land owner may do whatever it wishes to protect itself from surface water drainage without legal obligation to its neighbors from the resultant effects. The sole exception is that an owner cannot capture surface water drainage and cast it in a body onto an adjoining property. The separation of Clarksville's drain lines from Flood Control's 96-inch pipe in what was previously Cane Run would not violate this exception.

      The sole alternative is the improvements that are needed to FC's Cane Run Pump Station that would allow water to be pumped over the floodwall to the river when it is above flood stage before flooding occurs in Clarksville. If FC makes these improvements (either with or without financial contribution from Clarksville and Jeffersonville), problem solved.

The catch basins in Clarksville from which the flooding now surcharges when the river is above flood stage will remain in place -- they just won't be connected to FC's 96-inch pipe that causes the surcharging and flooding in Clarksville. Clarksville has no legal obligation to have them remain connected to the FC pipe.

      Thus, you are incorrect to state, "the owner...is authorized to do whatever is necessary". There are limits. Further, it is not clear to me that the rights of a property owner necessarily are identical to the 'rights' of a municipal entity.

    11. The Town owns Colgate Park and the Parks Department building on Sherwood Avenue, both of which are adversely affected by the malfunctioning Cane Run Pump Station.

      The alternative stormwater separation project would not change the discharge point for Clarksville drainage (i.e., it would still end up in the Cane Run drainage basin but could not cause flooding by surcharging back into Clarksville), and more importantly would not direct any surface water drainage towards Jeffersonville.

  16. The canal would have diverted a substantial percentage of the waters from Jeffersonville that surcharge from the FC pipe and flood properties in Clarksville when the river is above flood stage. It would have helped the situation, but it would not have eliminated the problem. Same can be said for the retention basin and combined sewer interceptor that the current administration promised, but which have yet to commence construction.

I harbor no ill will against the Mayor personally (in fact, I freely acknowledge I was appointed as County Attorney in 2009 only upon his invitation to apply and with his backing -- thankfully I don't have to do that job anymore). However, it is incumbent on the Mayor to now recognize that as chairman of Flood Control he wears more than one hat, and that the District has obligations to protect the owners of all properties located within it (including those in Clarksville).

  20. It's a shame the good people of Clarksville are being used in this misguided fight. I've worked side by side with town board members "Red" Worrall and Tim Hauber, and know how dedicated those two are to fixing Clarksville's flooding problems. I've stopped listening to the rest of the town board and manager make ignorant treats. The Jeff-Clarksville Flood control district also understands and sympathizes with our neighbors and want to help. Living along the Ohio River poses challenges for us all. Hopefully the political posturing stops and the high dollar hourly paid lawyer takes a dose of Pepto-Bismol to control his oral diarrhea.

  22. Anon. makes a good point dragging this into court undoubtedly will increase costs and possibly delay any solution to this dispute. The BatBlog wonders why if this is a feasible solution to the flooding problem that C'ville politicians just don't pony up the necessary funds, bite the bullet and fix the problem for the sake of their constituents. If Jeffersonville benefits so what, be a good neighbor and quit throwing out threats...
